Local government officers and senior executives face increasing scrutiny in Work Health and Safety (WHS) prosecutions

Content

Local government officers and senior executives face increasing scrutiny in Work Health and Safety (WHS) prosecutions and a need for greater diligence due to the strengthened industrial manslaughter laws under the Work Health and Safety Act 2011 (Qld) (QLD WHS Act). While these changes do not alter the scope of duties, they significantly increase exposure to penalties.

  • The implications of recent industrial manslaughter prosecutions and increasing targeting by the WHS Prosecutor.

  • The broad definition of "senior officer" and its application to local government CEOs      and senior managers.

  • Key practical steps for demonstrating WHS due diligence, such as incorporating WHS into executive meetings, addressing raised issues, maintaining contact with key WHS roles, receiving periodic WHS reports, engaging with staff on WHS matters, and ensuring adequate budgets for WHS issues.
